1. Acceptance of Terms

By downloading, accessing, or using the BarterTrade mobile application ("App"), website, and related services ("Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must discontinue use of the Platform immediately.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use BarterTrade. By creating an account, you represent that:

• You have the legal capacity to enter into binding agreements.
• Any information you provide is accurate and up to date.
• You are the lawful owner or authorized provider of any goods or services you list.
• You will comply with all applicable laws and regulations.

3. Our Service

BarterTrade provides an online marketplace that enables users to exchange goods and services through barter transactions. BarterTrade is a technology platform only and does not own, sell, purchase, inspect, store, transport, or guarantee any goods or services offered by users.

4. User Accounts

Users are responsible for maintaining the confidentiality of their accounts.

• Keep your login credentials secure.
• You are responsible for all activity under your account.
• Notify us immediately of any unauthorized access.
• We may suspend or terminate accounts that violate these Terms.

5. Listings and Trade Offers

When creating listings, you agree that:

• Listings accurately describe the goods or services offered.
• Photos are genuine and represent the actual item.
• You have the legal right to exchange the listed goods or services.
• You will not list stolen, counterfeit, illegal, or prohibited items.
• You will disclose known defects or limitations.

6. Prohibited Items and Activities

The following may not be listed, exchanged, or promoted on BarterTrade:

• Illegal goods or services.
• Weapons, firearms, explosives, or ammunition.
• Illegal drugs or controlled substances.
• Counterfeit or stolen goods.
• Hazardous materials.
• Adult or sexually explicit content.
• Human trafficking or exploitative services.
• Wildlife or protected species.
• Any content prohibited by applicable law or Google Play policies.

7. Trade Agreements

All barter agreements are entered into directly between users. BarterTrade is not a party to any agreement and does not guarantee that either party will fulfill their obligations. Users are responsible for negotiating, inspecting, and completing trades.

8. AI Recommendations

BarterTrade may use artificial intelligence to recommend trade matches, estimate values, and improve user experience. These recommendations are provided for informational purposes only and should not be considered professional valuation or legal advice.

9. Verification

Verification badges indicate that certain information has been reviewed by BarterTrade. Verification does not constitute a guarantee of quality, authenticity, ownership, legality, or successful completion of any transaction.

10. Fees

Some features may require payment, including premium memberships, verification services, featured listings, or transaction facilitation fees.

• Applicable fees will be displayed before purchase.
• Payments are processed securely through approved payment providers.
• Unless required by law, fees are non-refundable after the service has been provided.

11. User Conduct

You agree not to:

• Provide false or misleading information.
• Impersonate another person or organization.
• Attempt to scam, defraud, or deceive other users.
• Harass, threaten, or abuse other users.
• Upload malicious software or harmful code.
• Manipulate ratings or reviews.
• Circumvent platform security measures.
• Use automated bots without authorization.

12. User Content

You retain ownership of the content you upload, including images, descriptions, and listings. By uploading content, you grant BarterTrade a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content solely for operating, improving, and promoting the Platform.

13. Intellectual Property

The BarterTrade name, logo, software, AI systems, algorithms, matching technology, valuation methodologies, databases, and all related intellectual property are owned by BarterTrade or its licensors and are protected by applicable intellectual property laws.

14. Privacy

Your use of BarterTrade is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information.

15. Suspension and Termination

We reserve the right to suspend, restrict, or terminate accounts that violate these Terms, applicable laws, or Google Play policies, or that pose a risk to the Platform or its users.

16. Disclaimer

The Platform is provided on an "as is" and "as available" basis without warranties of any kind. We do not guarantee uninterrupted service, successful trades, item quality, authenticity, legality, or user conduct.

17. Limitation of Liability

To the fullest extent permitted by law, BarterTrade shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from user listings, barter transactions, disputes, fraud, loss of property, personal injury, or inability to use the Platform.

18. Indemnification

You agree to indemnify and hold harmless BarterTrade, its directors, employees, affiliates, and partners from any claims, liabilities, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

19. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after any updates constitutes acceptance of the revised Terms.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Zimbabwe, without regard to conflict of law principles.
